“Abortion Remains Safe & Accessible in RI” - State Supreme Court Upholds Reproductive Privacy Act

The Rhode Island Supreme Court on Wednesday upheld the constitutionality of Rhode Island’s Reproductive Privacy Act, in its decision in Benson v. State.

“I applaud today’s decision by the Rhode Island Supreme Court to uphold the constitutionality of our state’s Reproductive Privacy Act at a critical moment as our country contemplates the future of reproductive freedom,” said Rhode Island Attorney General Peter Neronha. 

“In 2019, I was proud to play a key role in our state’s codification of the important reproductive health care freedoms established by Roe vs. Wade and its progeny. We have now successfully defended the Reproductive Privacy Act against a meritless legal challenge that our Supreme Court dismissed today,” Neronha continued.

“The passage of the Reproductive Privacy Act and its continued viability ensures, during an uncertain national climate, that Rhode Island will not return to the days of illegal and unsafe abortions that put the lives of women in danger and created criminal liability for physicians,” he added. 

The RI ACLU also applauded the decision. 

“Today’s decision from the Rhode Island Supreme Court upholding the General Assembly’s authority to enact the Reproductive Privacy Act could not be more timely,” said Steve Brown, RI ACLU Executive Director. 

“It ensures that, no matter what the US Supreme Court does, abortion will remain safe and accessible in this state. Today’s ruling is a crucial victory for the privacy rights of all Rhode Islanders, and we commend the General Assembly’s foresight in enacting this statute in 2019.  The ACLU will continue to fight for the protection and expansion of this fundamental right,” he added.
