BREAKING: Cianci's Complaint Against York Delayed Until November 13th

On Thursday, around 4pm, representatives of Buddy Cianci’s mayoral campaign filed a complaint with the Board of Elections regarding alleged violations by Myrth York and the PACS Priorities PVD and Forward Rhode Island.

Cianci’s representatives believed that York has allegedly violated Campaign Finance and Reporting requirements and limitations by acting in coordination with a candidate for office. In this case, the candidate is Jorge Elorza.

The case was supposed to be heard this morning at Providence County Superior Court.

However, due to the Court updating their electronic filing systems, unless a hearing is deemed an emergency, no cases will be heard today or Monday. Judge Brian van Couyghan deemed Cianci’s complaint not be an emergency.

The complaint will now be heard November 13th in Superior Court. Cianci’s attorney, John O. Mancini, will file a motion for expedited discovery, and if he can move quickly enough, will file an appeal with the Supreme Court.

“We are going to come back and process it,“ said Mancini. “We will prosecute it even after the election because the violations are so great. Our primary issue is that there has to be a complete separation between the PAC and the candidate (Jorge Elorza). And here we think that there’s enough probable cause to assert that Myrth York works with the candidate and has worked with the candidate.”

Cianci’s party’s primary argument is that York cannot possibly say that she hasn’t been advising Elorza or anyone in Elorza’s campaign. York recently made a $10,000 donation to Elorza’s campaign. Mancini points to Brett Smiley, who endorsed Elorza for Mayor in August.

Mancini said, “York was one of Smiley’s primary advisors, and now Smiley is one of Elorza’s primary advisors. It doesn’t take rocket science to draw the line and make the connection between all those dots. What we need, and what we’re trying to do is to get sworn testimony from her so we can simply ask her did you or did you not have any discussion with Brett Smiley or any agent with the Elorza campaign. We think the answer to that is an affirmative “yes.” It’s illegal. It’s circumventing campaign finance laws.”

Mancini said, “If she has any had type of communications with anyone in the campaign, it’s enough to render it an issue. What we are looking for is to take her deposition and to ask her the question of whether the person making the expenditures is her.”

“No matter what, my client will fight win, lose, or draw,” said Mancini.
