Elorza Picks $1,000 Donor to Represent City in Jackson Recall Case

Mayor Jorge Elorza has tapped donor Bill Dolan to represent the City of Providence’s Board of Canvassers in the battle over the effort to recall Providence City Councilman Kevin Jackson.  Residents in the Third Ward are seeking to oust Jackson from his council seat.

Dolan, who recently gave Elorza $1000, has contributed $3500 both in donations and in-kind gifts to Elorza since 2014. 

The selection of Dolan may violate the City of Providence ordinance that requires outside council to be approved by the City Council.

Now, Council President Luis Aponte is raising questions about the hiring process. "I am concerned that the administration is hiring an attorney without going through the process. You can't just ignore a process," said Aponte. 

This is just the latest twist in one of the most dynamic political and legal battles. 

Dolan said he could not comment on the hiring on Friday and referred all questions to the city;  Elorza press secretary Emily Crowell refused to respond to questions about the conflict prior to the hiring.

According to the City Ordinance:

To be the chief legal advisor of and attorney for the city and all departments, boards, commissions, bureaus and officers thereof in the matters relating to their official powers and duties. No department, board, commission, bureau or officer shall employ any other attorney at the expense of the city or through the use of any funds from the federal government or other source, unless otherwise provided by this Charter, or unless the city council shall approve such employment by ordinance. Any such attorney so authorized by the city council shall be subordinate to the city solicitor and in all litigation to which the city may be a party, said attorney shall be under the direction of the city solicitor;

Dolan was hired without review of the Board of Contract and Supply which does require consideration of minority and women owned vendors.

According to Dolan's biography, he is is best known for work "including leading groundbreaking class action pension reform litigation in Rhode Island, and obtaining multi-million dollar jury and bench verdicts in state and federal courts throughout the region. His efforts have been central to important cases involving governmental entities, tobacco companies, construction firms, national retailers, and financial institutions."

Now comes William M. Dolan III of the law firm of Donoghue Barrett & Singal, P.C. and hereby enters his appearance in this case on behalf of Defendants Claudia J. Haugen and Renay Brooks Omisore, as members of the Providence Board of Canvassers, Lori L. Hagen, as Clerk of the City of Providence and The City of Providence, by and through its Treasurer, James Lombardi.
