The oldest synagogue in the United States will remain under the control of its congregation, after a protracted legal battle between Congregation Shearith Israel and and Touro Synagogue in Newport.

U.S. District Judge John J. McConnell issued his ruling on Monday May 16, putting to rest the fate of two sets of bells that the Newport congregation had agreed to sell to the Museum of Fine Arts in Boston for more than $7 million back in 2011.

McConnell ruled it is the congregation — not Shearith Israel, the oldest Jewish congregation in the county which is based in New York, who had become the synagogue’s trustee — who can determine the fate of the bells.

Furthermore, McConnell ruled that Shearith Israel can no longer serve as the trustee, and returned the control to Truro.
