Political Parties in Violation of Rhode Island State Law

Roughly half of Rhode Island Democratic and Republican city and town committees have not filed the required paperwork with the Rhode Island Secretary of State's office, as laid out in Rhode Island General Law.  

According to state statue 17-12-9, "all city, town, and district committees shall organize biennially in the month of January in every odd year; provided, that the city committee of the city of Providence shall organize quadrennially."

The Secretary of State's office provided who has -- and hasn't -- filed the organizing forms so far in 2015.

Cities and Towns Recorded

Election specialist Ysa Rodriguez provided the following list on April 2 for the Rhode Island Republican committees.

"The city/town committees which have filed with the state are Barrington, Cumberland, Exeter, Foster, Hopkinton, Johnston, Lincoln, Little Compton, Middletown, Narragansett, North Kingstown, Pawtucket, Portsmouth, Richmond, Scituate, Smithfield, Tiverton, Warren, Westerly and Woonsocket," wrote Rodriguez of the GOP committees.

"We have not received anything from Bristol, Burrillville, Central Falls, Charlestown, Coventry, Cranston, East Greenwich, Glocester, Jamestown, Newport, New Shoreham, North Providence, North Smithfield, South Kingstown, Warwick, West Greenwich and West Warwick," continued Rodriguez on the Republican side.

As far as the Democratic city and town committees, Gonzalo Cuervo with the Secretary of State's office provided the following. 

"The following Democrat City/Town Committees have organized: Barrington, Bristol, Central Falls, Coventry, East Greenwich, East Providence, Jamestown, Lincoln, Little Compton, Middletown, Newport, Providence, Richmond, South Kingstown, Tiverton and West Warwick," wrote Cuervo.

"We have yet to receive anything from Burrillville, Charlestown, Cranston, Cumberland, Exeter, Foster, Glocester, Hopkinton, Johnston, Narragansett, New Shoreham, North Kingstown, North Providence, North Smithfield, Pawtucket, Scituate, Smithfield, Warren, Warwick, Westerly, West Greenwich and Woonsocket," continued Cuervo.

Requirements - and Response

Under the statute, the law is stated as follows

"Each city committee organized under this section may elect not exceeding three (3) officers outside its membership from among the voters of the same political party in the city, and the officers shall, by virtue of their election, become members of the city committee and shall hold office until the next organization meeting of the committee.

Each city committee, town committee, and district committee, within ten (10) days after its organization, shall file with the secretary of state and with the local board a list of its officers and members.

The chairperson of the city committee of each political party in the city of Providence shall appoint the members of a ward committee for each of the several wards of the city of Providence. These appointed ward committee members shall hold office until their successors shall have been duly elected, qualified, and organized."

New Rhode Island Republican Party Executive Director Brandon Bell said that he would be following up with cities and towns as to their reporting status. 

"I need to check with the cities and towns listed.  I know that the Republican State Central Committee has been updated with most, if not all of the 39 cities and towns' reorganized committees.   Therefore, the RI GOP recognizes the committees mentioned who are allegedly not yet registered with the Secretary of State," said Bell. "While the provision of state law that discusses organization of Town and City Committees is superfluous for the function of the political party, I will be making sure that every committee is in full compliance, if it is not already."

The Rhode Island Democratic Party did not provide comment on Tuesday.
