Raimondo Signs Bills to Help Settle Lawsuits in St. Joseph's Pension Collapse

Governor Gina Raimondo signed legislation targeted at helping members of the St. Joseph’s Health Services pension plan reach settlements in their class-action lawsuits.

The bills, introduced by Senate President Dominick Ruggerio and House Majority Leader K. Joseph Shekarchi, will incentivize settlements by positioning members of the insolvent plan to reach fair, equitable settlements with the multiple defendants of the lawsuits.  

"Members of the St. Joseph's pension plan dedicated their careers to working at St. Joseph's, only to have the rug pulled out from under them through no fault of their own. I know many of those affected rely on their pensions for their livelihood, and I hope this legislation expedites an agreeable settlement,” said Raimondo.

Ruggerio added, "The beneficiaries of this pension plan, many of whom are my constituents, worked hard taking care of other Rhode Islanders throughout their careers. They did everything they were supposed to do, and were promised a secure retirement in return. This legislation affords them a proven legal strategy that has been used successfully to encourage settlements in other high profile cases in Rhode Island. Our intent is that it will result in a swift settlement that will make the pensioners whole or as close to whole as possible."

The Lawsuit

As GoLocalProv reported last week, Special Counsel Max Wistow sued Prospect Medical Holdings; Prospect CharterCare; the Roman Catholic Diocese of Providence and others for wrongdoing in the collapse of the St. Joseph Health Services of Rhode Island Pension Fund.

The Federal Court complaint is 136 pages and includes a 21 count complaint filed against 14 Defendants. Similarly, the state court complaint is 101 pages and includes 16 count complaint against same defendants.

The suit alleges massive fraud in the case which has created a hole in pension assets estimated to be in excess of $115 million.

The suit was filed by the receiver Stephen Del Sesto and was prepared by Wistow.
