The videographer, who was filming outside of the Rhode Island National Guard, said he was conducting a "First Amendment audit." The video was posted to YouTube on September 6.

"We got a call for a suspicious person, OK?  This is kind of suspicious behavior," says the officer, who arrived approximately sixteen minutes after the video started.

The officer and the videographer then get into a verbal dispute over what he is allowed -- or not allowed -- to be doing.

"If you're in front a facility that's a government building and you're filming -- it caught the attention of the security guard," says the officer. "It might be some cause for concern who you are and if you intend to do anybody any harm."

"I have no ill will," says the videographer.

"I can't take your word for it -- I'm going to ask you to ID yourself," says the officer.

"I'm a private investigative journalist getting content for a story- -- you should know unless I'm suspected of a crime I don't need to provide an ID," says the videographer.

Confrontation Continues

"I can't take your word for it -- I'm going to ask you to ID yourself," says the officer.  "Until I can determine you're not committing a crime I'm going to ask for an ID."

The video shows more officers arriving, with the videographer taking affront to physical contact with the police.

"Don't put your hands on me -- I don't consent to seizures or searches," says the videographer. "I will file a formal complaint. You're violating my rights."

The video ends with the videographer seated on the ground, in front of Cranston officers.  The full video shows that he was arrested.
