CharterCare CEO Holiver to Testify on Legislation Regarding Hospital Conversion Act

CharterCare Health Partners CEO John Holiver will testify on the importance of legislation introduced to strengthen Rhode Island’s Hospital Conversion Act on Wednesday.

The hearing will take place in the House Committee on Health, Education, and Welfare and is sponsored by Representative Kenneth Marshall. The existing statute has come under fire for failing to protect the pensions of plan members an retirees, as in the case of St. Joseph pension fund collapse in August of 2017.

“It is good public policy for the House and Senate to raise concerns about the current requirements of Rhode Island’s Hospital Conversion Act that do not properly entertain the impacts of a hospital system as large as Partners acquiring one of the largest employers and healthcare providers in Rhode Island. There will be too many unanswered questions if our current HCA laws are not strengthened,” said Holiver.

The Legislation

The legislation as proposed would put stipulations into the law if an acquirer is a hospital or hospital system located within a state immediately adjacent to Rhode Island.

The legislation would direct the Department of Health to consider among other things:

  • Whether the conversion will result in an increase or decrease of primary and specialty services
  • Whether the conversion will result in the migration of patients
  • Whether the conversion will result in the increase or decrease of the number of healthcare jobs in Rhode Island
  • Whether the conversion will result in an increase in cost to the state’s Medicaid program
  • Whether the conversion will result in an increase or decrease of local health insurance premiums
  • Whether the conversion will increase or decrease funds available for medical research, medical innovation and academic medical programs

The legislation would also prevent an expedited review by the state of an application under the Hospital Conversion Act if the acquiring hospital or hospital system is located within a state immediately adjacent to Rhode Island.
