Federal Court Rejects Moderate Party Lawsuit

A U.S. District Court judge has dismissed a Moderate Party lawsuit over public financing of campaigns.

In its suit, the Moderate Party said the current system of allowing taxpayers to make donations to Democrats and Republicans on their income tax forms unfairly discriminates against new third parties. But U.S. District Court Judge William Smith rejected the suit.

Attorney General Patrick Lynch, a Democrat, praised the decision yesterday.

“We believed from the start that state law governing the public financing of political campaigns was on very solid constitutional ground, and we commend Judge Smith’s decision today affirming the law and our belief,” Lynch said.
