The purpose of law is to create--or restore--peace, justice, and social order to a community. While many of these rules align with the ethics and morals of the societies they govern, not every law on the books makes perfect sense.

Every state and municipality has laws or ordinances that are outdated, irrelevant, and in some cases downright bizarre. But how do these laws end up on the books in the first place?

"Most of these laws would have been passed in reaction to some outlandish behavior which when investigated did not violate any then-existing laws; that in turn would lead to proposed bills which address the outlandish behavior," said former Massachusetts Speaker of the House and GoLocal MINDSETTER™ Tom Finneran.

Not as dumb as they appear

Many of these regulations are considered to be strange or dumb not because of their intent, but rather, because of loopholes in the language used. For instance, a town ordinance in Scituate, RI could be interpreted as a ban on possession of alcohol--even in a closed container. However, that law simply states:

"No person shall be in possession of alcoholic beverages upon any lands owned or controlled by the town without permission of the town council."

Removing outdated laws from the books

In most cases a repeal of these regulations is unnecessary, as many of these old regulations are not actively enforced.

But according to Finneran, removing laws from the books is fairly simple in Massachusetts.

"One would file a proposal to repeal the particular section of a statute or the entire statute itself."

When asked whether any strange laws passed through the Massachusetts State House during his time in office, Finneran declared "There were none! We believed in God, motherhood, apple pie, the Red Sox, and good government."
