RI Nurseries Reaches $800,000 Settlement with Town of Portsmouth

Providence lawyer Michael Kelly represented Rhode Island Nurseries in the lawsuit.
Rhode Island Nurseries, represented by Providence attorney Michael Kelly, recently reached a $800,000 settlement with the Town of Portsmouth, after suing the town for backing out of plan to extend a town road for a new development. 

The case dates back to 2011, when the Nurseries had been planning a residential development that needed an access point to the subdivision, but the town abandoned a needed extension to Heidi Drive when a neighbor objected. 

“I think my opinion, based upon what the town had offered to resolve the matter, the $800,000 was an excellent result, “ said Kelly. “Basically it puts them back into the position before the town illegally abandoned the second exit for the subdivision."

The result is the latest in a long line for Kelly, who had landed on GoLocal’s Power List this year for the state’s top lawyers and members of the Judiciary.

“The planning board approved [the development] with emergency access -- but the adjoining property owner had a personal lobbying effort to convince them they should abandon it, because it was harming his alpaca farm,” said Kelly.

“The settlement will cover most of the cost to construct the roadways,” said Kelly. “When there's a compromise, I don’t I think either side is fully satisfied, but we are pleased.”
