Smart Benefits: Delaware Says No to State Exchange

Last week, Delaware officials announced the state would not develop its own health insurance exchange, despite approval from HHS in June to do so. Instead, eligible residents will continue to receive coverage through the federal exchange.

Delaware’s interest in developing a state-run exchange was prompted by King v. Burwell, the case before the Supreme Court about whether federal premium subsidies would only be allowed to enrollees in state exchanges. According to Delaware.gov, just over 25,000 Delaware residents opted for coverage in the federal exchange during the 2015 open enrollment season, about 19,000 of whom were eligible for monthly premium tax credits that average $265.

The Court’s ruling that subsidies to enrollees in the federal exchange are legal in all states – not only those with their own exchanges – eliminated one of Delaware’s big concerns and, according to the state’s HHS Secretary Rita Landgraf.

In addition, Landgraf indicated concerned about possible cost increases to the state from shifting to a state-run exchange model.
