Two RI Health Professionals Placed on Probation - For Billing Patients They Did Not Treat

The Rhode Island Department of Health (RIDOH) has placed two physical therapist assistants on probation — for making and filing reports for patients they did not treat. 

On May 28, Wendy Butler Fox, Chair of the state’s Board of Physical Therapy, signed content orders placing Megan Chouinard and Bradley Roberts on probation for instances of filing false reports for patients they did not treat on a particular day.

According to RIDOH, this “constitutes unprofessional conduct pursuant to the Physical Therapy Statute, the Physical Therapy Regulations, and the APTA (American Physical Therapy Association) Coe of Ethics)."

The state documents did not provide details of where Chouinard and Roberts were working at the time. 

 

About Probations

According to the consent decree, their licenses will be marked as being on “active probation” for three years; they can apply for release from probation after two years. 

- Respondent shall complete 6 hours of continuing education on the topics of Ethics and

- Billing conducted in person or with live access to the presenter. Respondent shall submit evidence to RIDOH via [email protected] that 6 hours of continuing education have been completed no later than three months after the Effective Date.

- Respondent must assure that his Employment Supervisor ('Supervisor') provides a monthly attestation, in a form acceptable to RIDOH, that Respondent's billing statements are accurate.

-Respondent must obtain a Clinical Peer Supervisor ('Peer Supervisor'), approved by RIDOH, and assure that Peer Supervisor provides monthly reports, in a form acceptable to RIDOH.

-Respondent must see a Psychotherapist ('Therapist'), approved by RIDOH, at least monthly, for at least six months of Probation following the Effective Date.

- Respondent must assure that monthly reports, in a form acceptable to RIDOH, be submitted by the Therapist.
