On Wednesday, the Attorney General’s office rested in the prosecution after three days of testimony.

Now, it is the defense’s turn.

GoLocal has learned that the defense is expected to call Mattiello first. The Speaker was never interviewed by the Attorney General’s office and did not appear before the grand jury that handed down the indictment in the case.

Attorney General Peter Neronha announced on October 18, 2019, that Mattiello's political consultant Britt was indicted by a State Grand Jury on two charges —  felony money laundering and a misdemeanor charge of making a prohibited campaign contribution.

The felony money laundering charge carries a sentence of up to 20 years.

These charges are tied to a mailer sent in the coordination of the Mattiello campaign by a third party funded by Britt.

Mattiello has repeatedly said he was unaware of the mailer prior to it being produced.  His campaign spokeswoman has repeatedly placed all the blame for the mailer squarely on Britt.

"The Speaker has never engaged in this sort of activity prior to or after the 2016 campaign. It's simply how Jeff Britt operates," said Mattiello's campaign spokesperson Patti Doyle.

In 2016, Mattiello defeated GOP opponent Steve Frias by 85 votes.

Board of Elections

On Wednesday, the Board of Election's Richard Thornton testified under cross-examination that Britt was not seen as the violator by the Board of Elections, and that the violation being investigated was between the Mattiello and Lawton campaigns. The exchange seemed to bolster Britt's attorney's claim that Britt was being used as the fall guy.

Corrente: Mr. Britt was never the subject of the investigation at the Board of Elections, was he?

Thornton: He was part of the investigation that went into the complaint filed by the GOP….

Corrente: He was not the subject of that investigation, was he.

Thornton: He was not the subject.

Corrente: The subject of that investigation was the issue of whether or not there had been coordination between the Mattiello campaign and the Lawton campaign, right?

Thornton: That’s correct.

Corrente: The Board of Elections never fined Jeff Britt, did it?

Thornton: It did not.

Corrente: The Board of Elections never issued a warning to Jeff Britt, did it?

Thornton: It did not.
