Attorney General, RIDOH Delay Review of Prospect CharterCARE Hospital Conversion

Attorney General Peter Neronha and Rhode Island Department of Health Director Dr. Nicole Alexander Scott announced Tuesday that they are extending their review of the application of Chamber/Ivy (Prospect CharterCARE) under the Hospital Conversions Act.

Also, on Tuesday, GoLocal reported that the consultant tapped by Neronha issued a nearly 900-page report and found that Prospect/CharterCARE made the capital investments that they were required to complete.

“Following an independent, exacting, and comprehensive review, the Affiliated Monitors’ independent report has determined that Prospect Medical has met all the regulatory conditions set forth by the Rhode Island attorney general and Department of Health when Prospect’s acquisition of CharterCARE Health Partners was approved in June 2014.

Over the past year, Prospect has provided thousands of documents to Affiliated Monitors and answered scores of questions in interviews. Prospect is proud that this report conclusively proves our compliance with all conditions and puts to rest unfounded allegations that commitments had not been met, when in fact Prospect satisfied all conditions and -- in the case of its capital commitment -- exceeded the commitment made in 2014.”

No New Deadline Set

The review period has been extended beyond January 29, 2021 to ensure that the State has the "necessary time to complete a thorough review of the transaction, pursuant to its statutory responsibilities under the Hospital Conversions Act." The parties were notified via letter on January 18, 2021.

“Our healthcare work overall is increasing, both in its volume and its complexity. We have more people working healthcare now than ever before in this organization’s history,” said Neronha. “That’s because we know how important this work is to every Rhode Islander. It is imperative that we, and the Rhode Island Department of Health, have adequate time to conduct a thoughtful and thorough review of every aspect of this proposed transaction.”

Under the Hospital Conversions Act, the State’s review is “to assure the viability of a safe, accessible and affordable healthcare system that is available to all of the citizens of the state” and “to review whether for-profit hospitals will maintain, enhance, or disrupt the delivery of healthcare in the state.”

As of this date, a new deadline has not yet been set for completing the review of the initial application under the Hospital Conversions Act.
