Providence Restaurant Hit By Federal Suit Led by Chef, Claims Failed to be Paid OT

A Providence restaurant, Provy's Seafood & Tapas, was sued in United States Federal Court in the Rhode Island District on Tuesday.

Provy’s is the commercial name; the parent company is Seoul Providence, which is operated by Jun Zhang.

Provy’s dubs itself a “Mediterranean Inspired Seafood & Tapas Dining Experience,” and it is located at Davol Square.

On Instagram, Provy’s claims 20,000 followers.

In a 14-page complaint, plaintiff Daniel Guererro said he had worked as a chef at Provy's in 2024. 

The lawsuit claims, “Provy’s failed to pay Guerrero overtime for all hours worked in violation of the FLSA, RIMWA, and RIPWA, and on information and belief Provy’s failed to pay Provy’s Employees for all overtime hours worked, also in violation of [multiple federal and state labor laws].”

“Guerrero brings this action on behalf of himself and similarly situated current and former Provy’s Employees who elect to opt-in to this action pursuant to the Fair Labor Standards Act,” states the lawsuit.

Andrew Adams of DarrowEverett, the lawyer who represents Guerrero, the lead litigant in the lawsuit, said they are still assessing the total economic damages suffered by Guerrero.

Adams said Wednesday that it is unclear if the restaurant is currently operating. 

“Although the precise number of such persons is unknown, the facts on which the calculation of that number depends are presently within the sole control of Defendants.  The Rhode Island Class members are readily ascertainable. The number and identify of the Rhode Island Class members are determinable from the records of Defendants,” claims the suit.

According to the lawsuit, when Guerrero complained, he was fired via a text message.

Multiple calls to the restaurant were not responded to.
