Smart Benefits: ACA Employer Reporting Deadlines Extended

Last Monday, the IRS unexpectedly issued Notice 2016-4, which extends the deadlines for ACA information reporting. The new timeframes for the form submissions are:

The automatic and permissive extensions of time previously offered no longer apply. Employers or other coverage providers who don’t comply with these extended due dates are subject to existing penalties.  

The IRS will start accepting filings beginning in January 2016 and encourages employers and other coverage providers to furnish statements and file the information returns as soon as they are ready.

The Notice also provides guidance to individuals who might not receive a Form 1095-B or Form 1095-C by the time they file their 2015 tax returns. For 2015 only, such individuals may rely upon other information received from employers or coverage providers (insurers or self-insured plans) about their offers of coverage for purposes of determining eligibility for the premium tax credit or for filing their income tax returns. They also do not need to amend their returns or send copies to the IRS once they receive their Forms 1095-C or Forms 1095-B or any corrected Forms 1095, but should keep the forms with their tax records.
