Smart Benefits: Federal Appeals Court Upholds ACA Contraceptive Mandate

In the latest ruling on women’s access to contraceptives under the ACA, last week, a federal appeals court in Atlanta upheld the ACA contraceptive mandate requiring most health plans to cover FDA-approved contraceptives as free, preventive care. 

While Catholic dioceses and archdioceses are exempt from the mandate, other groups like schools and hospital aren’t. Instead, the groups must file paperwork with their insurer objecting to the coverage so its employees can receive coverage at no cost. Two groups – one a nonprofit organization affiliated with the Catholic Church in Georgia and the other Catholic broadcaster Eternal Word Television Network in Alabama – filed lawsuits claiming this opt-out requirement was overly burdensome to their religious practice and violated the Religious Freedom Restoration Act of 1993 that prohibits the government from imposing a substantial burden on a person’s religious practice. A three-judge panel of the court rejected the challenges to the mandate.

The appeals court said the ruling will not be enforced against the two organizations until the Supreme Court hears oral arguments on the issue in similar cases next month.
