Providence City Council Candidate and Campaign Worker Arrested by State Police

Colonel Steven G. O'Donnell, Superintendent of the Rhode Island State Police and Commissioner of Public Safety, announced that members of the State Police Financial Crimes Unit arrested a former Providence City Council Candidate and a campaign worker for alleged violations surrounding election fraud relating to the 2014 primary election.

On Wednesday, July 29 and Thursday, July 30, 2015, Franchesco Franco and Migdalia Rivera were arrested on multiple charges stemming from election fraud allegations during the 2014 Providence City Council Ward 11 Democratic Primary. Franco was a candidate for the Providence City Council seat and Rivera was his campaign manager.

An investigation by the Financial Crimes Unit originated from a complaint filed by the Rhode Island Board of Elections after several suspicious mail ballots were submitted during the primary election. The investigation revealed election violations of tampering with mail ballots, forging and altering mail ballot affidavits, embezzlement of mail ballots, and voting with a false address.

Franchesco Franco was charged with the following:

• Violation of Election Laws;
• Fraudulent or Repeat Voting;
• Using a False Residence for Voting Purposes;
• Embezzlement and Fraudulent Conversion; and
• Conspiracy.

Migdalia Rivera was charged with the following:

• Fraudulent or Repeat Voting;
• Forgery and Counterfeiting in General; and
• Conspiracy.

Franco was processed at the Lincoln Woods Barracks and arraigned in Providence Superior Court before the Honorable General Magistrate Patricia L. Harwood. He was released on $10,000 personal recognizance pending a pre-arraignment conference date of September 16, 2015.

Rivera was also processed at the Lincoln Woods Barracks and arraigned in Providence Superior Court before the Honorable General Magistrate Patricia L. Harwood. She was released on $10,000 personal recognizance pending a pre-arraignment conference date of September 16, 2015.
